Mini Sessions – Terms & Conditions

In these Terms & Conditions, “the Photographer” means Eva Bradley Photography and “the Client” means the person making the booking. By booking and paying for a mini session, the Client agrees to these terms.

1. Session Booking & Payment

Full payment is required at the time of booking to secure your mini session.

Unless otherwise stated, outdoor mini sessions are designed for up to six people. Studio mini sessions are for one person unless another arrangement has been agreed in advance.

Mini-session payments are non-refundable, but may be transferred to another available mini-session time within the same seasonal release (for example, spring or autumn), subject to availability.

If you are unable to attend and your original appointment can be filled by another client, a refund may be provided less a 10% administration fee.

2. Timing & Attendance

Mini sessions run to a tightly scheduled timetable. Please arrive ready to begin at your allocated appointment time.

If you arrive late, your session may need to be shortened so that subsequent bookings are not affected. The session cannot normally be extended beyond the original finishing time or rebooked for another time.

3. Photography Style & Creative Direction

The Photographer retains creative control over the way the session is photographed and edited, including composition, location, lighting, posing and image selection.

While requests are always welcome, individual photographs, poses or specific combinations of people cannot be guaranteed. By booking, the Client acknowledges that they are engaging the Photographer based on her established photographic style and artistic judgement.

4. Image Delivery

Your mini-session package includes professionally edited, high-resolution digital photographs as outlined in the session description at the time of booking.

Images will normally be delivered within approximately three weeks of the session.

Digital files are supplied ready for personal use and printing. For the best results, professional photographic printing is recommended. The Photographer cannot be responsible for colour, cropping, quality or other printing issues arising from third-party printers, labs or consumer printing services.

5. Weather, Illness & Rescheduling

If unsuitable weather prevents an outdoor session from going ahead, the Photographer will arrange an alternative date or mini-session opportunity.

If the Photographer is unable to carry out the session because of illness, emergency, severe weather, natural disaster, government restriction or another circumstance reasonably beyond her control, the Client will be offered an alternative date where practical. If the session cannot reasonably be rescheduled, payments made for the affected session will be refunded.

A re-shoot or refund will not normally be provided because of clothing choices, hairstyle, make-up, children’s behaviour, failure to follow preparation advice, late arrival or other circumstances outside the Photographer’s control. Any decision to offer a re-shoot is at the Photographer’s discretion.

6. Copyright & Personal Use

Copyright in all photographs remains with Eva Bradley Photography.

The Client receives a licence to use the supplied photographs for personal purposes, including printing, displaying in their home and sharing with friends and family or on personal social-media accounts.

Images may not be sold, commercially reproduced, entered into competitions, supplied to another business for promotional use or otherwise used for commercial purposes without prior written permission from the Photographer.

7. Use of Images by the Photographer

Unless otherwise agreed in writing, the photographs from the session will not be used by Eva Bradley Photography for portfolio and promotional purposes

8. Liability

Every reasonable care is taken in photographing, storing and delivering your images.

In the unlikely event of complete photographic failure, loss or corruption of images for reasons outside the Photographer’s reasonable control, the Photographer’s liability will be limited to the amount paid for the affected mini session.

The Photographer will not be liable for indirect or consequential loss arising from the session.

Clients are responsible for themselves and any children or other people attending with them while at the session location. Nothing in these Terms & Conditions excludes or limits any rights or remedies that cannot legally be excluded under New Zealand law.

9. Image Storage

Image archive is the responsibility of the Client. The photographer will store images digitally for six months from the date of the shoot and after that time the photographer is not liable for storage or archive of any images from the session.
